Dog attacks - a common occurrence

According to the Center for Disease Control and Prevention, 4.7 million people in the U.S. are bitten by dogs every year.  Unfortunately, we have seen many clients, particularly children, with serious injuries resulting from dog bites.  Laws are in place to ensure that owners take responsibility for the actions of their pets.

Most common injuries resulting from a dog attacks are:

  • Facial and body scarring

  • Disease and infection

  • Nerve damage

  • Puncture wounds

  • Broken bones, joints, and tissue damage

  • Psychological damages, such as PTSD, anxiety and more

Who will pay for my injuries?

In Colorado, owners are often held strictly liable for injuries that their pets cause. Even if they had no previous knowledge that the animal was capable of an attack, they still may be responsible for various damages, including medical bills and other costs of healing.

What if the dog owners are my friends and I don't want to sue them?

In nearly all cases, we first attempt to locate an insurance policy that may provide coverage for your injuries.  Various examples would include homeowners insurance, renters insurance, a commercial policy for a business, or an umbrella policy.  Many times, we have found it to be beneficial to have the option of collecting damages from an insurance company, rather than solely pursuing the dog owners.  This is especially helpful in instances where the owner of the dog is a close friend or relative and the dog bite victim is uncomfortable collecting damages directly from the owner, or when the owner does not have the money or assets to pay for the damages themselves.  Every case is unique, and we work hard to get to know our clients and their individual needs, so that we can fight to obtain their best outcome.

What will happen to the dog?

Oftentimes, dog bite victims do not want anything to happen to the dog.  Most often, absolutely nothing happens to the dog except that it might be quarantined for a few days (frequently at the dog owner's home). If, in the extreme case that the attack is brutal or other conditions are met, however, the local animal control authority or court may issue orders requiring that the dog be confined or destroyed.  Rest assured, contacting the Dible Law Firm to discuss the details of the attack is kept completely confidential, and we will never report the bite without the injured party's consent.

Do I need an attorney?

If dog bite victims have a lawyer, they will usually recover two to three times the amount they would have received without an attorney, even after paying attorney's fees and costs.  An insurance adjuster will often offer a dog bite victim only 10% to 20% of what they would offer a client with an attorney, so the insurance company will save money by keeping the other 80% to 90%.  Many insurance companies take advantage of the fact that most people do not know all of the compensation that they are entitled to for their injuries and its total worth.  Further, we've seen some insurance companies try to use information they are not legally entitled to have in order to discount, or disregard, parts of a person's claim all together.

The Dible Law Firm can help.  We will:

  1. Use our expertise in determining the full nature and value of your claim and fight for the maximum compensation that you are allowed under the law for your injuries

  2. Fully investigate all aspects of your case in order to make your claim as strong as possible

  3. Use our extensive knowledge of complex dog bite law to determine the legal theories of your case, including premises liability and negligence, in order to gain the most leverage for your claim

  4. Communicate regularly with you regarding all aspects and progress of your case

  5. Track down all available coverage for your claim

  6. File necessary documents with the court

  7. Handle all communication and responses to the insurance companies and their lawyers

  8. If desired, help you find doctors and specialists, as we know some of the best in the area that can help you recover from your injuries

  9. Help protect your privacy by redacting unnecessary medical information out of the records sent to the insurance companies

  10. Negotiate, on your behalf, any outstanding liens or medical bills that derived out of the accident or attack that caused your injuries, in order to maximize your take home compensation

  11. Advance all upfront costs of the claim (i.e. costs of obtaining medical records, filing the case in court, expensive expert testimony regarding the accident or your injuries, filing fees, service fees, court reporter fees, etc.), so that you do not have to pay any costs prior to obtaining compensation for your injuries

  12. Use our expert negotiation skills to win you the best possible outcome for your case, or litigate the case in court if fair compensation is not offered to you by the insurance company.  We will fight hard for YOU.
